The property dispute surrounding late businessman Sunjay Kapur continues to intensify, with fresh arguments surfacing in the Delhi High Court. During the latest hearing, a statement made by Karisma Kapoor’s daughter, Samaira Kapur, prompted the court to firmly reprimand the legal team representing her and her brother. The long-running battle over Sunjay Kapur’s estate has now taken another dramatic turn.

The High Court was hearing an interim injunction petition filed by Samaira and her brother Kiaan, seeking to stop their stepmother, Priya Kapur, from selling any assets belonging to the late industrialist. The dispute, rooted in allegations of will manipulation, has steadily grown more contentious since Sunjay Kapur’s death earlier this year.

Samaira Claims Her College Fees Are Unpaid

During Friday’s proceedings, senior advocate Mahesh Jethmalani—representing Karisma Kapoor’s children—told the court that Samaira, who is studying in the United States, had not received her university fee for the past two months. He argued that the responsibility for these expenses lies with Priya Kapur, who, according to them, currently controls the children’s share of Sunjay Kapur’s assets.

Jethmalani asserted that under family and marriage laws, Sunjay was obligated to cover the education and living expenses of his children. Therefore, any assets meant for Samaira and Kiaan should be utilised for their welfare, he argued.

However, this line of argument did not sit well with the bench.

Court Reprimands the New Argument

Justice Jyoti Singh sharply criticised the introduction of the fee-related claim, stating that such personal matters should not be brought before the court unless necessary. The judge made it clear that this issue should not be raised again in future hearings.

“I do not want to spend more than 30 seconds on this,” Justice Singh remarked. “This question should not come before me again. I do not want the proceedings to turn theatrical. The responsibility lies with you to ensure this matter is handled appropriately.”

The court also directed Priya Kapur’s senior counsel, Shyel Trehan, to ensure that any such concerns related to the children’s expenses are resolved properly outside the courtroom. The next hearing in the case is scheduled for November 19.

Priya Kapur’s Counsel Rejects the Allegations

Responding to the claims, senior advocate Rajiv Nayar, appearing for Priya Kapur, refuted the allegation that Samaira’s fees were unpaid. He asserted that all expenses submitted by Karisma’s children had already been settled by Priya. He further urged the court to keep such disputes separate from the central issue of the case, which primarily involves the validity of the disputed will.

Background of the Dispute

Sunjay Kapur, Karisma Kapoor’s former husband and a noted businessman, passed away on June 12 in London after reportedly suffering a cardiac arrest while playing polo. His death opened the door to a complex legal battle over his estate.

Shortly after his passing, Samaira and Kiaan filed a lawsuit against their stepmother Priya Kapur, accusing her of tampering with Sunjay’s will. They claimed that their father had repeatedly assured them of their rightful share in his property—an assurance they believe has been omitted from the final version of the will.

The siblings have sought legal intervention to prevent Priya Kapur from taking any decisions regarding the estate until the authenticity of the will is verified.

A Case Growing More Complicated

As the legal fight continues, both sides have levelled serious accusations against each other. With questions surrounding inheritance rights, property control and now personal expenses, the dispute has grown increasingly complex.

The Delhi High Court will continue hearing the matter later this month, where both parties are expected to present further arguments regarding the contested will and the future of Sunjay Kapur’s estate.

The case remains under close public and legal scrutiny, particularly because it involves a prominent family and sensitive allegations related to inheritance and trust.
